These Terms of Service govern your access to and use of the Smart Dream Home website, web application, mobile applications, and related services operated by Smart Dream Home Corporation, a British Columbia company (“SDH”, “Smart Dream Home”, “we”, “our”, or “us”).
By accessing or using our services, you agree to these Terms of Service. If you do not agree, do not use the services.
1. Scope of These Terms
These terms apply to:
- https://smartdreamhome.ca
- https://app.smartdreamhome.ca
- https://prototype.smartdreamhome.ca
- any SDH-branded mobile application published for iOS or Android
- any related content, tools, data, communications, and support services we make available
Additional terms may apply to specific features, pilot programs, promotions, or third-party integrations. If there is a conflict, those additional terms govern for that feature only.
2. Eligibility and Account Registration
You may use the services only if you can legally form a binding agreement under applicable law. If you create an account, you must provide accurate and current information and keep it updated.
You are responsible for:
- maintaining the confidentiality of your login credentials
- all activity that occurs under your account
- notifying us promptly if you believe your account has been used without authorization
We may suspend or restrict access if we reasonably believe an account is being used in a way that creates security, legal, or operational risk.
3. What the Services Do
Smart Dream Home provides digital tools intended to help users explore property information, organize preferences, review AI-assisted insights, compare options, and connect with relevant real estate professionals or service providers.
The services are provided for general informational and decision-support purposes only. Unless we separately agree with you in writing, the services do not create:
- an agency, brokerage, fiduciary, advisory, or client relationship
- a representation agreement in a real estate transaction
- a mortgage, legal, tax, financial, or investment advisory relationship
- any obligation for SDH to negotiate, verify, or complete a transaction on your behalf
If a separate written agreement is required for a regulated or professional service, that agreement will govern that service.
4. No Professional Advice
Content made available through the services, including AI-generated summaries, valuation indicators, affordability estimates, property comparisons, neighbourhood information, or market commentary, is provided for general information only.
AI-assisted outputs may be incomplete, inconsistent, outdated, or incorrect. They may reflect assumptions, inferred patterns, model limitations, or source-data issues.
You should not rely on the services as a substitute for professional advice from a qualified real estate professional, mortgage professional, lawyer, accountant, appraiser, inspector, or other adviser.
AI-assisted content should not be treated as a substitute for professional advice, due diligence, or independent verification.
Any purchase, sale, lease, financing, or investment decision is your responsibility.
5. Data Accuracy and Third-Party Sources
The services may display information that comes from third-party sources, user submissions, public sources, open data, partner systems, or automated models. While we aim to present useful and timely information, we do not guarantee that any listing, property detail, valuation, map location, school information, market statistic, affordability figure, or other content is complete, current, accurate, or suitable for your needs.
Information may change without notice. You should independently verify any material information before making an important decision or entering into a transaction.
You are solely responsible for your decisions, actions, and reliance on information obtained through the services.
6. Limited Licence
Subject to these terms, SDH grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the services for your personal or internal lawful use.
You may not:
- copy, reproduce, republish, sell, sublicense, or commercially exploit the services or their content except as expressly permitted in writing
- scrape, crawl, harvest, mine, index, frame, mirror, or systematically extract data from the services
- use bots, scripts, or automated means to access the services in a way that overloads or interferes with them
- reverse engineer, decompile, disassemble, or attempt to derive source code from any software except where applicable law clearly permits it
- interfere with security features, rate limits, access controls, or usage restrictions
- use the services to build or train a competing dataset, model, or product without our written permission
- use the services for unlawful, fraudulent, misleading, abusive, defamatory, or infringing activity
7. User Content and Feedback
If you upload, submit, save, transmit, or share content through the services, including account profile information, saved preferences, support requests, uploaded files, comments, or feedback, you represent that you have the necessary rights to do so.
You retain ownership of your content, but you grant SDH a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt, display, and use that content as necessary to operate, secure, improve, and support the services.
If you provide feedback, suggestions, or feature requests, we may use them without restriction or compensation to you.
8. Mobile Application Terms
If you download or use an SDH mobile application:
- the app is licensed, not sold, to you
- you may use the app only on devices you own or control and only as permitted by these terms and the applicable app store rules
- you are responsible for any mobile carrier charges, data usage fees, or device-related costs
- your use of the app may depend on third-party platforms, operating systems, or app store services that we do not control
If you obtained the app through the Apple App Store, you acknowledge that Apple is not responsible for the app or its content, except to the extent required by law. If you obtained the app through Google Play, your use must also comply with Google Play’s applicable terms.
9. Account Deletion and Service Cancellation
You may stop using the services at any time.
If you want to delete your account, you may submit a request through any in-app or web-based account-deletion function that we make available, or by contacting us at info@smartdreamhome.ca.
To protect account security, we may require you to verify your identity before completing an account-deletion request. After verification, we will process the request within a reasonable period, subject to any legal, security, fraud-prevention, backup, or record-retention requirements that apply.
Deleting your account may result in the permanent deletion or anonymization of profile information, saved properties, saved searches, favourites, notes, and other account-linked content, except where retention is reasonably required by law or for legitimate business purposes such as security, audit, dispute resolution, or enforcement.
10. Paid Features, Billing, and Subscriptions
Unless expressly stated otherwise in the services, Smart Dream Home does not currently charge a recurring subscription fee for basic access.
If SDH offers paid features, premium subscriptions, or in-app purchases now or in the future:
- pricing, billing frequency, included features, trial terms, and renewal terms will be disclosed before purchase
- subscriptions may renew automatically unless cancelled before the applicable renewal date
- subscriptions purchased through Apple or Google must be managed and cancelled through the applicable app store account settings unless we clearly state otherwise
- except where required by law or applicable app store rules, fees are non-refundable once charged
- we may change subscription pricing or features for future billing periods by giving notice as required by law or platform rules
Your access to paid features may end if a subscription expires, is cancelled, is refunded, or is suspended because of a billing issue or a breach of these terms.
11. Communications
By creating an account or using the services, you agree that we may send you service-related communications such as authentication messages, account notices, security alerts, transactional confirmations, updates about saved activity, and support responses.
Where required by law, we will ask for consent before sending promotional communications. You can opt out of marketing messages using the unsubscribe method provided or by contacting us, but you will still receive essential service and legal notices when necessary.
12. Privacy
Your use of the services is also subject to the Smart Dream Home Privacy Policy. That policy explains how we collect, use, disclose, store, and protect personal information.
13. Intellectual Property
The services, including their software, design, interface, text, graphics, branding, logos, compilations, and original content, are owned by SDH or its licensors and are protected by intellectual property laws.
Nothing in these terms transfers ownership of any intellectual property rights to you except for the limited licence expressly granted above.
“Smart Dream Home” and related names, marks, logos, and branding may not be used without our prior written consent.
14. Third-Party Services and Links
The services may contain links to third-party websites, map tools, data providers, analytics providers, communication tools, app stores, or other external services. We provide these for convenience only.
We do not control and are not responsible for third-party services, their availability, their content, or their privacy and security practices. Your use of third-party services is governed by their own terms and policies.
15. Suspension and Termination
We may suspend, limit, or terminate your access to the services at any time, with or without notice, if:
- you breach these terms
- we believe your use creates risk to users, partners, systems, or the public
- we need to investigate suspected fraud, abuse, or unlawful activity
- we discontinue a service, feature, or pilot program
You may stop using the services at any time. Sections that by their nature should survive termination will continue to apply, including sections concerning intellectual property, disclaimers, limitation of liability, indemnity, and dispute-related terms.
16. Disclaimers
To the maximum extent permitted by law, the services are provided on an “as is” and “as available” basis, without warranties, representations, or conditions of any kind, whether express, implied, statutory, or collateral.
Without limiting the above, SDH disclaims all implied warranties or conditions of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation.
We do not warrant that:
- the services will always be available, uninterrupted, secure, or free from bugs
- property, map, AI, pricing, or market information will be accurate or complete
- defects will always be corrected immediately
- the services will meet every user’s expectations or objectives
17. Limitation of Liability
To the fullest extent permitted by law, SDH and its directors, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, savings, goodwill, data, opportunities, or business interruption, arising out of or related to your use of or inability to use the services.
To the fullest extent permitted by law, our aggregate liability for all claims arising out of or related to the services or these terms will not exceed the greater of:
- the amount you paid us, if any, for the specific service giving rise to the claim in the 12 months before the event giving rise to liability, or
- CAD $100
Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
18. Indemnity
You agree to indemnify and hold harmless SDH and its directors, officers, employees, contractors, affiliates, licensors, and service providers from and against claims, liabilities, losses, damages, costs, and expenses, including reasonable legal fees, arising out of or related to:
- your breach of these terms
- your misuse of the services
- your violation of law or third-party rights
- content you submit or actions taken through your account
19. Changes to the Services or These Terms
We may modify, suspend, or discontinue any part of the services at any time.
We may also update these terms from time to time. When we do, we will post the updated version and revise the effective date above. If required by law, we will provide additional notice.
Your continued use of the services after the updated terms take effect means you accept the revised terms.
20. Governing Law
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in British Columbia, without regard to conflict of law rules.
Unless applicable law requires otherwise, you agree that the courts located in British Columbia, Canada will have exclusive jurisdiction over disputes arising from or relating to these terms or the services.
